Information for Members Claiming to be Affected by the HIV Privacy Mailing Issue

As part of administering the settlement of two lawsuits, a notice was mailed to certain current and former Aetna health plan members regarding filling prescriptions for medications to treat or prevent HIV/AIDS. The mailing was sent on July 28, 2017, and some of your protected health information may have been inadvertently visible through the window of the envelope used to send the notice.

If you were sent this mailed notice on July 28, 2017, then you are eligible to apply to participate in Aetna’s program to provide, where appropriate, immediate relief to potentially affected individuals.

There are two types of immediate relief available.

First, if you or a family member want or need counseling services related to this potential disclosure, please fill out the information as requested and email the completed form to the email address identified on the form. Please include your email address so we can contact you regarding how you can receive up to three counseling sessions. Download the counseling request form.

Second, if you have incurred or will incur immediate and emergency out-of-pocket unreimbursed expenses that you reasonably believe to be caused by this potential disclosure, please fill out the information as requested and email the completed form to the email address identified on the form. Please include your email address so we can contact you regarding your request for reasonable reimbursement. Download the financial relief form.

Alternatively, please feel free to phone or email the AIDS Law Project of Pennsylvania at 215-587-9377 or aetnaclass@aidslawpa.org or the Legal Action Center (New York residents only) at 212-243-1313 or lacinfo@lac.org. The AIDS Law Project of Pennsylvania and Legal Action Center, non-profit public interest law firms providing free legal services to people living with HIV and AIDS, have agreed to assist with the processing of requests. Additional information about the AIDS Law Project of Pennsylvania can be found at www.aidslawpa.org and the Legal Action Center www.lac.org.

Determinations of requests for financial reimbursement, payments or counseling services will be made at Aetna’s sole and complete discretion. Requests for financial reimbursement, payments or counseling services will be evaluated by Aetna and determinations made as quickly as reasonably possible.

Please don't forget to email each form once completed. You may email forms for one or both categories. Note that Aetna is not requiring you to release any legal claims that you may possibly have relating to the July 28, 2017 mailing. Further note that Aetna is not admitting any liability or fact by offering this program to provide immediate relief and reserves all rights and defenses. Payments under this program may be subject to maximum payable amounts and will be made at Aetna’s sole and complete discretion.
